Lawsuits filed in recent days by Westinghouse and Duke Energy both assert they are owed money for work related to a proposed nuclear plant in Levy County, Fla., that was not built.
Progress Energy, which later merged with Duke, had begun the preliminary licensing work to build two AP1000 reactors and filed for a combined license from federal regulators in 2008. Last year, Duke Energy suspended the project indefinitely as part of a larger settlement with the state's Public Service Commission that also addressed the closed Crystal River 3 reactor.
On Monday, Westinghouse filed a suit in a Pennsylvania district court that claims the company is owed $512 million for engineering, design work and other costs related to the project, the Pittsburgh Post-Gazette reported. Duke partially suspended work on the plant in 2009 but directed Westinghouse to continue to support the project as necessary.
That suit follows a filing by Duke on Friday in a North Carolina district court asserting that Westinghouse actually owes the utility $54 million. The Tampa Bay Times reported that Duke claims it does not owe Westinghouse money and is due a refund for turbine generators and reactor vessel components that were not produced.
